What is Marriage Certificate?

Marriage certificate is the letter of proof that announces the marriage practice with validation.

Why it is required?

To state and authorize one’s marriage with proof of honor and existence marriage certification is required. Marriage is sole proof of married life and one’s marital status. The purposes of marriage certificate are ceaseless they are required at the time of attaining passport, changing maiden name etc.

Officially Authorized Structure:

The Hindu Marriage Act, 1955

Under this act the registration of already solemnized marriage is done. It does not provide the solemnization of marriage by the registrar if the marriage has not taken place.It is applicable when both couple belongs to same religion.

Considerations:

  1. The marriage ceremony has taken place between the parties and they have been staying together since then.
  2. Neither party has at the time of registration more than one spouse living.
  3. The boy should have completed 21 years and the girl must have completed 18 years.
  4. The parties are not within the degrees of barred relationship

The Special Marriage Act, 1954

Under this act solemnization as well as registration of marriage is done by a marriage officer. Marriage Registration is done 30 days after submission of documents analyzing objections that have been received during 30 days period. Both the couples need to be present with three witnesses on the date of registration. It is applicable irrespective of religion.

Considerations:

  1. Neither of the party should have existing valid marriage
  2. The male should have completed the age of twenty-one years and for females age of completion is eighteen years;
  3.  The parties are not within the degrees of banned relationship:
  4. When the marriage is solemnized in the State of Jammu and Kashmir, both parties have to be citizens of India domiciled in the territories to which this Act extends.

Documents required when marriage has been solemnized

  • Application form signed by the couple.
  • Matriculation Certificate / Passport / Birth Certificate for age verification.
  • Husband or wife’s ration card certified by area Sub deputy magistrate
  • Residential proof residing more than 30 days in Delhi
  • Affidavit by both the parties stating place and date of marriage, date of birth, marital status at the time of marriage and nationality.
  •  Two passport size photographs of couples and one marriage photograph.
  • Marriage invitation card
  • A certificate from the priest is required who solemnized the marriage for Hindu marriage act 1954
  •  Confirmation that the parties are not related to each other within the proscribed degree of relationship as per Hindu Marriage Act or Special Marriage Act as the case may be.
  •  Attested copy of divorce decree/order in case of a divorcee and death certificate of spouse in case of widow/widower.
  •  In case one of the parties belong to other than Hindu, Buddhist, Jain and Sikh religions, a change of religion certificate from the priest who solemnized the marriage(in case of Hindu Marriage Act).
  • All documents except the receipt should be attested by a Gazette Officer.

  • Matriculation Certificate / Passport / Birth Certificate for age verification.

  • Affidavit by both the parties stating place and date of marriage, date of birth, marital status at the time of marriage and nationality.
